Ontario Judge Strikes Down Marijuana Laws

A medical marijuana ruling gives the feds 90 days to amend anti-drug legislation. If they don't, pot could be legalized in Ontario.

In a case that has rejuvenated legalization supporters, an Ontario judge ruled this week that Canada's laws against the production and possession of marijuana are unconstitutional. The Ontario Superior Court ruling struck down two sections of the Controlled Drugs and Substances Act that the judge had decided impeded Matthew Mernagh's access to medical marijuana when he was unable to find a doctor to prescribe it for him. The judge gave Mernagh a “personal exemption” to grow his own marijuana until then. The federal government has 90 days to respond to the ruling. If it does not, possessing and growing marijuana in Ontario will effectively become legal.
